Received a Bill for State Tax on An Amp Bought in Canada Last Year


Wow! The envelope said “Dept of Revenue” so I figured it may be my car tags due. I opened the envelope to find a statement that I owed $665 for “use tax” on an amp I bought last year in June.  Shocked is an understatement. Yes, I bought a used amp from a guy in Canada through A’gon. But I paid the tariff on it. Now they also want tax.  However, the amount they are basing it on is over double what I paid for the amp. But had to send it to Don Sachs for repair a few months later. So I wonder if they are seeing that as a separate purchase rather than a repair. They even charged me $43 interest which is more ridiculous IMO.
So the question...Are you required  to pay tax on a used amp or other used  items? Has anyone else encountered this? Yes, I know the states are cracking down on the sales tax. But on used items? Wow

Used or new is irrelevant. It’s a sales tax, so if an item was purchased through a legitimate trackable business, they’ll seek to collect sales tax for the sale.  A garage sale item or personal deal between two private parties is much less likely to trigger a sales tax flag.

Remember the Democrats Utopia: You will own nothing, and be happy.

Tax is usually based of a dollar amount you paid. Like 3% 6% etc. Do you have the original bill? Can't you argue that it should, if anything, be x amount?
I’ve lived in California for 82 of my 83 years, so I think I have a handle on the problem.

None of the ones you mention. Bet you will be surprised. Give you a clue. They have no state income tax. So instead of that they come after retired people who buy used stuff. OK Its Tennessee. 9.75% sales tax. I suppose it is a fair system but it took me many years to get used to paying a nearly10% tax on every item purchased except a RX. They/we are doing alight with that system.

@oregonpapa Nice links. Many if not most have no idea how much total taxes they pay. We have become conditioned to pay it. I can’t remember the site which tells you how long you must work to pay your full tax burden but many years it on into middle of May. And this is the average American. Some pay 55-60-% of their income. The founders fought a war over 3% (I believe) We get used to it because we are conditioned to do so . We call it "break in" on our new equipment & tubes.

Sales tax was paid when the unit was New, if used then you 
pay it’s insured value , for if a product is in need of repair when mailed it should be marked unit is not working in need of being rebuilt .you pay what it was insured for . If it didnot work 
then never insure more-then 1/3 rd the value. I learned  this long ago dealing with the thief’s in customs ,if in Canada far worse.

Isn't all this terrible left wing money grab the OP is talking about happening in the Good Ole Boy state of Tennessee? What's California got to do with taxes this Red State is stealing from it's fine upstanding citizens? 
I’m not sure what Tennessee requires... but... I thought they defined a "seller" as a legal business entity who sells at retail to consumers, as the type of transaction upon which they levy a sales tax.

I am unaware that they levy any sales tax on a simple sale between two private parties, in which the seller is not such a "seller" as defined by the Tennessee "Sales and Use Tax Code." With the exception of when you register a vehicle or boat from such a sale.

Further, it appears that the maximum sales tax rate in Tennessee by all jurisdictions is 9.75%. To arrive at a "sales tax" bill of $665, would imply the "retail sales price" was $6820 - which does not appear to be the case here.

I’d contact the Tennessee Dept of Revenue... directly... via their published phone number and ask them. I doubt you’ll find they sent you a sales tax bill for such a transaction on an amp priced as low as you suggest, which was purchased from a private party (not a retail seller).

On the other hand... if... you actually did purchase from a "retail seller" as defined by the tax code... and... the real value of the amp is as you suggest (and not $6820), then you will find the actual "sales tax" is very likely less than $50 or $60.  

When the state cannot collect a sales tax from a seller in another country (or another state), it can impose a “use tax” upon the purchaser often at the same rate as the sales tax. And I believe this is true in a private transaction between a buyer and seller via Audiogon although that transaction and the resulting use tax is seldom ever found.  The buyer is theoretically supposed to report the transaction to the state - never happens.  It was pure (bad) luck that the tax collector found out about it.  It was probably an error in valuing the amp by a little bureaucrat in the Tennessee department of revenue, not a Qnon conspiracy of Democrats.  A lot of venting going on in these posts. Years ago I purchased an $8,000 pair of Focal speakers for $5,000 from a Canadian dealer. I may have paid customs on it, I don’t remember. But years later the California Board of Equalization caught up with me  - the purchase was traceable  - and I had to pay a Use Tax based upon the $5,000 purchase price, plus interest and penalties. No Big Brother paranoia was involved here.

Parts Connextion is an audio parts seller located in Canada and changes no sales tax on orders to the US. Do they have to? Don’t think so as they do not have any physical or other connection to the US (nexus)  I am aware of. 
When I bought an amp from Parts Express, I got the wrong model so it had to be sent back and I had another one sent to me. When returning it, I was told to state it was going back for repairs or a mod to avoid any hassle with customs and the whole declarations mess, and that was many years ago.

Things haven't seemed to have changed so I wonder why the OP wasn't informed about it or it could just be some overzealous official in TN.

Nope, that’s not how in works in Tennessee - you won’t find an exemption for used items on its sales tax website. (In fact, the state invokes especially strict rules for taxing used motor vehicles.)

In addition to its sales tax, the state also has a companion "use tax" that applies "when the sales tax was not collected by the seller on otherwise taxable products brought or shipped into Tennessee. The use tax applies to all items otherwise subject to sales tax ..."

One in four families are at the food scarcity level in the entire US, not knowing where their next meal will come from. That’s just the average and in some states, it’s much, much worse.

A lot of the homeless come here to get away from other states that treat them poorly. In fact, some of those states criminalize homelessness and they look down on them, punishing them when they can. Besides, the weather here is mostly nice, year round, so add it all up and Bob’s your uncle.

Using google, look up any state and their homeless rate, and compare that to their population as a whole, and get back to me on what you find out. While doing that, also look into what each state does for their working poor as well as their homeless.

California has a homeless population of 0.4%, but has 22% of the nation's homeless. 13% of the homeless come from out of state. The rest are residents who fell on hard times, mostly through medical bills that bankrupted them.

Wow.  So much California Bashing.  Most have no real clue what they are actually talking about.

Laws were passed some years ago regarding internet sales and that sales taxes had to be reported to the IRS.  Most people still don't do that by-the-way.

Also, this is one major area where internet sales prices were lower than brick and mortar store prices.  The internet seller didn't add sales taxes to the total price. So, brick and mortar stores started failing.  now people are actually complaining that there are not stores in their neighborhoods.  Go figure.

I for one prefer to do business with local brick and mortar stores, pay slightly more to have them stay in business.  but that's me.  But, it is getting harder to find them now.  Especially book stores.  Still have Vroman's in Pasadena.  Wow, what a book store.

I for one have absolutely no problem paying extra taxes for public health care and other things. I think that is what a civilized country should do.  But again, that is just me.  

as far as sales tax is concerned, I know California and many other states passed laws mandating that sales tax has to be recorded and paid for new and used equipment.  I don't understand the need for sales taxes on used equipment, when the sales tax was initially paid with the original purchase.  Seems like double dipping.  I don't think this is fair.  But, maybe I'm missing something. 

If a person buys something new in California, they pay the sales tax.  If they sell it to another person in California, why should there be a second sales tax?  don't get that one.

I'll just add; 20 years ago I was trying to get a position in San Diego, but just couldn't. There was nothing available. Now, even during the the Covid scare, I'm getting head hunters cold calling me with positions all up and down the coast. They cannot fill the positions. Nobody with a grain of sense is interested in moving to CA anymore.

In some CA cities, middle income families are living in RV's as they cannot afford a home. In TX, low income families can afford to live in a home and often 2 cars. Wow indeed.

1.  For the mentally ill who cannot fend for themselves, reopen the mental hospitals that were closed due to ACLU lawsuits so they can get proper treatment and medication to at least lead a life without seeing and hearing demons. Hot showers and three good meals a day would be mandatory. 

2.  For the addicted, mandatory rehab programs, privately run for a profit. The better the outcomes, the more the rewards.

3.  For those who have been priced out of California homeownership, bus them to Pennslyvania. Harsh winters, I know, but a nice house is around $150,000. Rent is cheap too ... especially around January or February.

For the rest who just love living on sandy beaches for free, constructing tent cities in the Mojave Desert would be a good choice. Air-conditioning and rabbit stew provided, of course. 

And your solutions are what, exactly ... besides raising the minimum wage, providing a "living wage, stimulus checks, or a monthly packet containing newly counterfeited money?

Progressives have solutions. They just have no way to pay for it other than taking it from those that have some $$$. Then at some point, after they have the tax high enough to destroy incentives, businesses and the morale of the people, the govt confiscates everything just to pay the elites at the top. Progressives have nothing. First of all there are no progressives. There are only Marxists, and other variations on communism. Progressive is the term they thought would work here in the US. But the same tired old ideas never will work, no matter whether called progressive or even liberal.  

These terms are all either specific to their classical definitions, or else useless. But by their classical definitions conservatives want to conserve the status quo, which at the time was a royal monarchy in Great Britain. Liberal literally means free, so the Founders were liberal. Today, those who still cling to the Constitution are called conservative because they seek to conserve that which the liberal Founders gave us.

I'm taking time to explain all this to expose the lie behind the word progressive. There is nothing progressive about it. You seek to regress back to an old discredited system where one elite group of technocrats holds power and wields it over all the rest of us common folk.

You can imagine you “spanked” me as much as you want, but no adult considers cursing at somebody because of your own comprehension error as “spanking” anyone. Most adults would be very embarrassed by it. You’re patting yourself on you back and deflecting. 
So please run along and leave me alone. I have no interest conversing with anybody who is not adult enough to apologize for his bad behavior. I suggest you should seek out  people closer to your own age.

Just getting that notice that a post of yours was removed triggered you that much?
