Thin Line Between Critique and Courtrooms: A Dialogue on the Recent Audiophile Drama

Hey Audiogonians,

In the vast, vibrant universe of audio reviews, where the line between subjective opinion and objective analysis often blurs, a new saga unfolds. It involves a Youtuber, well-known within our community for their take on speaker designs – designs that, while innovative, haven't shied away from criticism. The plot thickens with another Youtuber's revelation: the speaker's designer and manufacturer has filed a lawsuit against a reviewer over their less-than-glowing feedback.

The core of the debate? Whether it's acceptable to push back against reviewers when their findings diverge from what manufacturers desire. It's not a new drama; history is littered with tales of reviewers facing legal threats for daring to express their truth. Yet, each story brings a fresh perspective on the delicate dance between free speech and brand reputation.

This particular episode raises several intriguing questions:
- Where do we draw the line between constructive criticism and damaging feedback?
- Is the courtroom really the arena for settling disputes over reviews, or should dialogue prevail?
- And crucially, what does this mean for the future of honest, independent audio reviews?

This isn't just about the nitty-gritty of legal battles, many of which remain cloaked in confidentiality and technical jargon. It's about the principle: the right to voice one's opinion in a space that thrives on diversity of thought.

So, fellow audiophiles, what's your take? Have you ever felt swayed by a review, only to discover a different truth upon listening? Have you faced the ire of those who didn't appreciate your candid feedback?

📢Let's make this a discussion to remember – not just for the controversy, but for the unity and respect we can foster, even in disagreement.

You win the lotterie with me i am very much imperfect...

😊

I myself love perfectible people and you seems one ... 😊

@mahgister I like most imperfect people. It’s the perfect ones I can’t stand. 😊

Every person difference is a richness for all of us..

The more different the better it could be if we try to understand... 😊

@mahgister ,

Nous avons ici un groupe très diversifié, mon ami!

Je pense que la plupart d'entre eux sont des gens bien.

@mahgister, my apologies. Sometimes sarcasm doesn’t read well, my mistake. Also, I did not know English is not your first language. i will be more mindful.
Regards

Biv

I must apologize too because i know i spoke too much...😁

But this small misfortune here is a good thing for me because it was an occasion to exhange with a gentleman...😊

My best to you

@mahgister, be concise. Also, you are in no position to lecture on kindness; you’ve been abrasive with great consistency.

I am as you are yourself not perfect but i do not confuse order with invitation...

I am abrasive sometimes but there is generally a reason... And if there is no reason sometimes i am abrasive with arguments , not with insults, and only sarcasms or orders and commands, this is my form of kindness speaking to the working mind of my friend ...

And i treat everyone on the same level then able to understand rational of arguments...

And i dont entertain grudges by the way ...😊This is my kindness...

I will never be concise because many things cannot be explained or described in few sentences as music mysteries or acoustics concepts etc or philosophical ideas ...( i am retired and miss my younger friends )

And i am not english born speakers i lack the art of ellipse and innuendos ...

Think about the way your "friend above was "kind" toward me ...😁

I discuss with you here just now , did i use order, insults, innuendos ?. No ...Only rational sentences...

My best to you ... 😊

I think it’s fair to say @mahgister is guilty of smiley face emoji abuse. 😜😝🙄

You said truth so well i cannot object and only confess and even add i am guilty of too much words too 😁...It is a pleasure to confess my own  truth with you ... ☺😊

But i am made such... Imperfect ...

@mahgister Biv... has been on Audiogon almost as long as you, just the man of fewer words, this does not mean he is forbidden to suggest.

Do you understand the difference between an imperative and a polite invitation or suggestion?

Especially after a meaningful post of mine explaining why i dont share Amir ideology even if i like his work ?

«Imperative verbs work by issuing a command to the person being addressed. »

Now is this man of "few words" know the difference between an order given to a poster he never discussed with and a polite and friendly suggestion ?

The question here is about not the number of words but about their meanings and context and about politeness and civility...We share ideas as humans we do not impose orders as a gang of apes...

My post suggested a relatively short thoughtful reflection , his post is an emotional uncontrolled reaction bordering on insult the way it is given ...😊

Your interpretation then reflect your own emotional reaction not the discussion context at all..

You dont like reading a poster skip him ...

We are not all on the same levels about everything here ... Then respect is recommended even for man of "few words" ...

Sorry i am not a man of "few words" ... 😊😁 i treat everyone as friends here ... I am made this way but i answer to those who attack me politely but with arguments ...

If you want to create a burst of violence in a jail play Mozart music said to me one of my psychologist friend. I hope that we are not in a jail with brutes on the brink to explode if someone put "mozart" thoughtful music here. 😊

i like thinking sorry...

Amir ideology is called techno-cultism...

It is pervasive in A.I. sleepwalking engineers crowds with no deep understanding of what is at stake in society right now...

This cult is born from hubris as soon as after the materialism dominate Anglo saxon Empire and the world after the victorious nominalism. It was a necessary stage for the advent of science but not the only one.

Techno cultism act of birth is just after Goethe Faust which denounce its blindness and denounced the replacement of the " free philosopher of nature" by the deal make in hell with the specialised unfree scientists working for the power in place and his corporations . In 1836 Wavell and Babbage, the father of A.I. in a reunion asked for the replacement of the title "philosopher of nature" by the shorter name "scientist" . Then the free philosopher was replaced by unfree specialised and controlled servant of corporate satanic powers. The same powers William Blake denounced in his own ways .

Techno cultism is a religious faith toward the only incoming God : A.I.

For them only measures are real. Human live in illusions. 😊

The modern era produce uneducated specialised slave workers called "scientists"; ask a doctor. many did subordinate Hippocrates oath to big pharma controls, if not tey are  ejected as incompetent. I will stop here ...😊

History teach well .

Sorry i dont see which post of me you refer too ... 😁

You must had cited the post ...

My last post is a one line approval of a common place fact ...😊

Anonymously here disdain often appear as hate especially if repeated behaviour , and i dont know what you refer to about juvenile loathing and petty behaviours...

i rarely speak in enigmas here ... But directly.... It is more simple this way ...

@magister You seem to confuse hate with disdain and loathing of juvenile and petty behaviors… Pick better heroes,,,

How surprizing! 😁

But the courts are the playthings of the rich who can use the process to delay, harass and intimidate people.

We even have many different perspectives in mind for every word!

The greatest linguist in the world is a french speaking one. It is not by random. 😉

Those French have a different word for everything!

i do not see it exactly from the same perspective but i cannot object anything about  thecarpathian opinion ..

😊

Learned about his personality years ago on some now deleted threads where he among other things threatened to sue fellow members for 'slander'.

So, @johnk ,

It isn't about tearing down Tekton. Its about calling out arrogant bullies who, after yet more threats of litigation against someone and the ensuing avalanche of negative press it brought, now tries to sugarcoat what he originally did by playing the misunderstood good guy.

I couldn't care less about the company. I've never disparaged the sound of a Tekton speaker in my life. It's bullies I have no tolerance for.

You seem a kind, decent fellow whose heart is in the right place. The world needs more people like you.

People like scapegoating and they like to hate...

I remember the days where someone here was very much hated...

I dont mind if the reason to hate were good or bad...

I dont hate anybody , but i reacted to posts for sure ... 😁

I understand the two sides here and i sympathize with the two sides...

All is rarely black or white about anybody nor about any matter ...

In the meantime there is an acoustic revolution and nobody pay attention... All eyes are on our dearest chosen scapegoat...😊

I just replied...

but in your urge to insult people you seems you need the last word...

This was my answer :

"I am not a perfect human being too  because i answered you ... 😊"

now we go back to the matter of the thread...

Enjoy the evening ...

I will return back your question to yourself ? why do you need sarcasm instead of argument in an audio platform especially against someone as rational as atmasphere ?

For my mental health personal report , it is not for you here to have an answer...

This thread is about a precise matter which you can adress as i did myself and atmasphere with "arguments" and reason ...Not with insult, innuendos, sarcasms only and mainly ...

Anybody using arguments and reason here is welcome... Even me... 😁

By the way i never "impose" my opinion as you just did with your personal adress to atmasphere, me i always gave plenty of arguments and  anybody can reply with arguments  ... Nobody can give an argument as answer to sarcasm, as your useless pointing to atmasphere "ego" was...

is it clearer ?

I am not a perfect human being too  because i answered you ... 😊

@mahgister

I repeat, " Why do you waste your supremacy on such a trivial platform as this?"

Also, why do you have to impose your opinion on any subject?

A review of a product, for example speakers, based on specs measures or in subjective impressions in a room , or the two together is always a debatable matter, because there is always many parameters, many different needs at play, the only exception is if the speakers are very bad design to begin with ...( but very bad speakers design do not go very far in sales)

then for me any reviews result as any design from a set of trade -off choices, in the designer intention as well as in the reviewers needs and wishes...

Where are the dots ?

If you look at one side they are there, if you look at the other side they are there...

there is no absolute truth in design no more than in reviewing...

Designer must not use threat of legal pursuit and reviewers must be cautious in their choice of words for sure ...

The extinction illusion: the left side and the right side have the same number of black dots...

In reality, both sides of the image contain the same number of black dots, but our brains' selective attention and processing mechanisms cause us to perceive them differently. This illusion highlights the complex interplay between perception, attention, and cognition in shaping our visual experiences.

I am not patient as atmasphere is with people insulting others..

I came here to learn patience reading poster as you displaying insult to well know useful member with no argument...

For the moment the cure is not effective ... 😊

@mahgister

Have you considered professional help?

@atmasphere

You should repress your ego.

I dont remember atmasphere "ego" very much all around the place since the 8 years i came here..😊

He always spoke the best he can to help everyone here with acoustics and engineering information ...

Smartest-guy-in-the-room is it not me ? 😁

If it is not me, it is certainly not you either, you (we) have too much "ego" anyway, then stay calm instead of attacking someone who just gave in a rational way his own well motivated , if debatable, opinion among a raging crowd...... ( i was raging myself against threat to a reviewer for sure)..

😊

There’s a fine line on ethical definition(s) as well. Way too many, but the best remedy -- the very best remedy is being truthful whether there is or there isn’t fine line or multiples of fine lines simply because there’s only one singular truth and one singular definition that can break any web or mesh of fine lines.

I agree completely with this attitude in life for sure... Truth is over anything else...

😊

But once this is said an audio product review imply as a medical reporting truth a fine line about what must be said with the right choice of word... We can say our truth without making it a negative destruction of the product...

«He said with good reason for sure  :" your body is wrong beyond repair 35 years ago"»-- Groucho Marx surviving cancer 🤓

I myself most of the times lend way much more credibility reading a reviewer about his "reserves" and "between the line implication" than about a flat negative remarks...

And we have users reviews which are not constrainted by any ethical professional guideline anyway ... I used statistical users analysis myself ...

There is difference between flat negative observation and cautious choice of words... There is a reviewer ethical line, implicit or explicit ...

Then atmasphere post make sense to me ...

We have way more users opinions than reviewers opinion to compare to anyway...

I concur with atmasphere here ...

This does not means that negative impressions must not be written in the diplomatic form of reservation or very cautious wordings ..

Being ethical is a fine line ...

Staying objective too ...

If a magazine or reviewer is on the up and up, if a product falls well short of a good review, the ethical thing to do is to send it back to the manufacturer without any mention in print (or in this case, online). Out of sight out of mind, quite simply. Put another way, a rising tide raises all boats.

Your post reveal you did not listen the video and your post is hearsay or uninformed opinions about this video ...

The dude in the video is rational and spoke of the situation in general  in a legalistic perspective and his consequences.. And i think the same as him, ... 😊

I couldn’t bear to watch the whole video but it sounds like mostly hearsay to me.

I dont mind that it was somebody in his garage or a pro; i dont give a damn.😊

It is ludicrous to ban reviewers by legal pursuit threats...Period...

I estimate freedom of speech more important than what is borderline between opinion and defamation especially if the reviewers can prove that his opinion is motivated and grounded in his experience and is not pure defamation as it seems the case here...

My sympathy here goes with the reviewers not with any designers...

Suppose the reverse, what will become of audio reviews ? 😊

A good product cannot be impeded by few bad reviews, a good product will survive with many users and reviewers good reviews anyway ...

It appear to me ludicrous to settle audiophile reviews in courtroom...😊

But the fact that we are or not a "man" or a "woman" may or must now be settled in courtroom with the irrational delirium instilled in the social fabric...

Even privacy dont exist anymore in a world where our own body property can be settled also in court ...

And tomorrow there will be those who want A.I. as God and the others who prefer a  natural tree and no body modifications.

The next war will be religious between artificial life and natural life...

Then....

May God help us...😊
